A major flaw with our system is that there is no punishment for passing unconstitutional laws, combined with the fact that unconstitutional laws are enforced until they are rejected by the court, which takes a long while. Once the law is overturned, you can pass it again, and have another period where it's in effect, which defeats the whole purpose of having courts.
