Sure, let's make everything illegal like in every broken country in the world. Laws such as this just show there are too many people living too near eachother. A major flaw with our system is that there is no punishment for passing unconstitutional laws, combined with the fact that unconstitutional laws are enforced until they are rejected by the court, which takes a long while. Once the law is overturned, you can pass it again, and have another period where it's in effect, which defeats the whole purpose of having courts.

Instead, the way it should work is that if a law is found unconstitutional by a court, then all legislators who voted for that law become ineligible to ever hold federal office after their current term expires.

This is the piece of "natural rights" that gets lost too many times in conversation. Yes, they are naturally inherent to our condition. But it is equally natural that a portion of the population always works to enrich itself through the enslavement of their fellows. A true "natural right" is a quality of being human that when overly abused will trigger a violent response to defend that quality. It's not "out there" being given to us. It's something we have always possessed, but unless people show their teeth when this human quality is challenged, those who want slaves will never recognize that they have crossed the line. The right appears when the people appear to defend it.
