That case is almost 80 years old and pertains to company towns. If I had westlaw or nexis, I could shehardize it. Really I think the best avenue of attack would be antitrust, which itself dicey, but above that removing immu it as a platform. These assholes are publishers, and thus should not receive immunity from defamation. That may chill more free speech though.

Yeah it is relevant. And the precedent hardly applies to what we are talking about. It would be hard to argue that facebook, twitter are acting in the shoes of the government the way a company town does....

Social media platforms are not state action. Running and administering a town are. Found this:

Utilities like telephone companies, electricity, etc. all are regulated and have First Amendment protection. The electric company, though private, cannot cut off your power if you're a communist.

That is an excellent rationale but utilities are regulated in a way that social media is not. The power company or telephone not being able to shut power off does not have anything to do with the first amendment. The worst part is, GOP had control of congress, and Trump did nothing...
