Not quite, I believe in that case it was multiple counts of sexual assault and sexual assault by penetration, but none of rape. Rape in England & Wales is strictly defined as penetration with an actual penis. I doubt whether a transman with a phalloplasty would be charged with rape as their defence would almost certainly argue it’s not a penis, and so the charge would be sexual assault by penetration.

In the US this is by state law of course so it may vary, but generally no. The definition in the US tends to be broader, and the distinction between rape and other sexual assault is any kind of penetration. And the rapist doesn't necessarily have to be the penetrator like they do in the UK (though obviously this is usually the case).

It was until People v Turner happened.

The "only penis with penetration is rape" mindset is extremely common in the world because the female is always seen as the victim and the man as the perpretator. The only cases where male rape is taken seriously is when a gay man rapes a straight man and it needs to have penetration.

This is not only problematic for women but for married straight men and asexual men as well.

Yeah, how quickly they discount the inciting incident - sexual assault/rape.

The trouble was he did three stupid things, he tried to destroy evidence, he ran and he sent incriminating texts. If you’re going to claim self-defence you can’t really act like you just did a murder.

It is rape by deception. Assuming he was genuinely deceived. Trans people never pass in real life and it isn't unheard of for gay/bisexual men in denial to have sex with hst/transwomen. And attack them afterwards, pretending they only just realised that they've had sex with a man.

Does rape by deception apply in Australia? Even if it does this case clearly goes beyond self defense.
