That applies to military operations but the poisoning appears to be the work of patriotic Ukrainian babushkas (or the Ukrainian equivalent).

This is International Humanitarian Law and applies to non military as well. If you'll note, this is NOT international war law. It is an attempt to establish humanitarian law and this specific rule applies to both international and national conflict.
