Texas: A robber approached the victim by lifting his shirt to expose a gun and demanded he fork over any valuables. The victim, however, was also armed and pulled out his weapon and shot the suspect in the face. No charges are expected to be brought against the victim, as he was defending himself.

This is pretty typical, based on the information provided on the article the shooter is fully protected by Texas law.

This is why brandishing a weapon is considered a crime in Texas, it is assumed to be a threat.
