Curious as to how "cruel and unusual" was not claimed to a court by the dead guy's lawyers.

It was, of course. The courts ruled against them.

Apparently, Smith had indicated that he would prefer nitrogen hypoxia to another attempt at lethal injection (the first one was botched).

IT WOULD BE SO CHEAP TO JUST TIE THEM TO A TRAIN CABOOSE.. HOOK EM UP WITH A CHIAN AND DRAG THEM TO DEATH..

OR, YOU COULD JUST TAKE EM A COUPLE HUNDRED MILES OFFSHORE AND TOSS EM INTO THE OCEAN.
