Newsmax Media, Inc. published their retractions.

And as has been pointed out, the defence so far by Sidney Powel has been "What I said was so obviously bullshit that it couldn't have been interpreted as factual, so there was no defamation."

Which I think won't stand, as some of the damages to Dominion are well documented.

And she also tried "Everyone else was defaming Dominion, and so singling me out is unfair". I don't know enough Law to know if that will fly, but I hope that it only affects the judgement of her liability, not whether or not she defamed.

Fox News has claimed first amendment. I don't think that will fly, given the circumstances of them contacting the Trump campaign beforehand and offering to broadcast whatever they were saying.

Not one of them is saying, "yeah, it was true, you were created by a long dead Venezuelan president, not in fact in Toronto as the record shows".

Because that's obviously lies. (See Sidney Powell's defence).

That makes no sense. Fox News isn't going to run out of capacity to go to court before dominion. The they were a fraud they would not be engaging in legal action, because the legal action would out the fraud.

And none of the defendants are using the truth argument. Which again only makes sense if everyone knows that Dominion are not a fraud.

If they don't initiate counter sue that will be used against them, so they are forced to sue to cover up their fraud. If they had done nothing wrong then they wouldn't need to sue because they would not be concerned about being sued.

They're suing because the defamation has caused them loss of business, and security costs, as their people and their relatives have been getting threats.

I notice that Newsmax Media, Inc. have been dropped from the suit, following their retraction.

Sidney Powell is attempting the defence that “no reasonable person” could have mistaken her wild claims about election fraud last November as statements of fact..

While this is probably true, many Dominion employees have received death threats. Defamation law should take into account how unreasonable people would interpret the claims.
