If you commit fraud on your representations to someone who is considering loaning money to you, and the consequence of that is that they underestimate your risk and give you terms that makes their return on investment smaller by more than $100M, you've committed Fraud. Because you've lied to make yourself $100M richer and them $100M poorer.
