The difference between Stewart and Trump’s cases is that Trump also sometimes lied to lenders about how big his properties were, including the square footage of his Trump Tower apartment.

Which is where the crime is. Trump defrauded a bank out of the $454 million (less interest) by overvaluing his property, and thereby inflating his assets that were security for a loan.

Jon Stewart did not overvalue his property, he sold it for more than it's valuation. He did not commit fraud.

The $454 million bond to appeal the ruling marks the highest bond ever recorded in United States history against a single individual.

Foxnews is mistaken about this.

  • Trump does not need to post a bond to appeal the ruling. He needs to post a bond to stay the judgment. He can appeal without the bond, but New York will be seizing and selling his properties while he does it, to get their $454 million.
  • The reason it was $454 million, is because that's how much money he defrauded, and has to return. As it happens, he only has to put up less than half that, because he's broke, and the court felt sorry for him. But he's still going to have to pay the $454 million. (Unless he has a better argument that he didn't commit fraud, than has been in evidence from his inability to raise a bond). You don't get to keep money you got from crime.

    In real estate one of the common ways to guesstimate the value of a property is to use a process called comparables, where you figure out what comparable properties or similar properties have sold for in the local area in the recent time.
