He wasn't potus when he defamed Rittenhouse, so the legal protections might not be as solid?

this could at least be done to have senate investigations and a special counsel like with bill clinton and white water

Or the stuff looking into Trump and Russia.

No suing or prosecuting but it can help make a president look bad.
