Probably correct- technically. The caveat being the fact that DEI and ESG are radical leftist causes for which the law can be willfully ignored in order to further. If the agenda were America first patriotism the roulette wheel of concern would land squarely on laws protecting shareholder interest and multiple investigations would open up.

Complicit media would ensure the unfolding scandal would remain headline news for as long as it took to take down offenders who might find themselves targeted by "unrelated" sex abuse or rape allegations- also prominently carried by "news" media.

According to the law shareholders have rights to maximum profits so corporations and their boards have to make every effort towards that. But you won't see any shareholders suing any company that is losing profits for being woke. Like could Bud Light be sued? No, because every judge is bought off by Soros.
