If trump appeals, it doesn't look like he will do it on the grounds that he didn't commit the fraud.

His defence, if he attempts it will be because his victim was the bank, and they happened to get paid back as they would have if he had been a smaller risk.

If you commit fraud on your representations to someone who is considering loaning money to you, and the consequence of that is that they underestimate your risk and give you terms that makes their return on investment smaller by more than $100M, you've committed Fraud.
