But an email from the Jefferson County Education Association told teachers that if they give such surveys, to make sure to they are pencil and paper … because “any digital records are more permanent and may be requested under federal law.”

The email also “encouraged” teachers to “make […] notations about students and not hold on to the documents.”

Doesn't really sound like a missive written by people who are sure they're on the right side of history.

There's something fishy about this story, but I can't put my finger on what exactly.

This is good information if it's accurate:

Federal and state law forbid mandatory surveys that ask about kids’ “protected information,” and voluntary surveys must include a parent opt-out.

But the default should always be opt-in, not opt-out. It won't be, marketers pay mega bucks to DMA to make sure of that.

I read that, but somehow I suspect that's not the part they wanted to cover up. They obviously wanted to circumvent that and poll ALL the kids without the parents' consent, which should lead to lawsuits and firings, but I suspect there was something in the results they wanted to hide.

Hmm. What could have been in the results? There aren't that many things possible, I would think.
It seems a really tight focus of questioning.

We do not know the results, but in theory they do.

Which of the possible results would they want to hide, and which would they not want to hide?
