I mean...

The road WAS closed down because of the protest. They were allowed to be there, but the motorist in question was reportedly fleeing from police and entered the highway from the oncoming lane, and blew through the barricade. This guy is a scumbag, and I don't care what your opinion on the protests is, but it's never a good thing when someone gets killed.

You mean they weren't physically prevented from being there. If you break the law, and a cop doesn't stop you, that doesn't mean you are NOT breaking the law. The city might face a lawsuit for selectively choosing to not enforce the law that night, but I think the protesters having knowingly broken the law at the time will free the city of liability.
