There were a lot of allegations in all the crimes and all the details of those crimes in the indictments. So he may that may well have been amongst the allegations. An act committed in furtherance of an illegal conspiracy is illegal, whether or not the act itself is illegal.
It's not illegal to buy a gun, but if you make a plan to kill someone with a gun, and that you will buy a gun for that purpose, then buying a gun is illlegal.
It's not illegal to drive a car, but if you make a plan to drive a getaway vehicle after your colleagues rob a bank, then driving that car in furtherance of that plan is illegal.

The prosecution is not malicious. A conspiracy to commit election fraud and turn the votes in Georgia from Biden to Trump is very much illegal.
Impersonating the electoral college electors is illegal. Faking official documents to say that they are the genuine electors is illegal. Breaching voting machines is illegal. Knowingly lying to public officials is illegal. Georgia's rico act is broad enough that organizing to do these things falls under the act.
Even if the case is moved to federal court (again, unlikely), they will be applying Georgia law, and the case looks very strong:

The good news is that presidents won't be able to pardon him on these charges, because they're state charges. And in Georgia to apply for a pardon "You must have completed all sentence(s) imposed upon you at least five (5) years prior to applying and have lived a law-abiding life since the completion of your sentence(s)." The chance of Trump living a law-abiding life for five years after he gets out is negligible, and by then he would have served his sentence.
Good on Georgia. This case is particularly clearly laid out, and the choice to allow cameras in the courtroom appears to be a concession to transparency, which is needed against trump's attacks on the legal system.
But there were six other states in which Trump had fake electors. And if he was doing that surely he was trying to breach voting machines, attacking innocent officials and trying to get people to misrepresent the voting totals in other states as well.
