Who's gonna make that call, though? Even if his mind is going I think it's more likely that he acts as a placeholder for 2 years until he can resign without this counting as a term for Harris under the 22nd.

The VP and the cabinet, presumably. Though Congress has already established a commission to do it (which doesn't matter if the cabinet agrees).
