There's a limit of 40 subs period.

Ok a user can mod 40 subs... but they can also mod 40 default subs?

That rule was made before default subs were a thing. But the owner is the top mod of pretty much all of them. He did add a couple other admins as mods for some reason, I don't know why. One of them doesn't like to log in to admin mode for some reason, so in his case that's probably why.
