This Court has consistently assumed the importance to the dual-sovereignty doctrine of both expressions of sovereign power. The analysis thus asks not only whether the two law-giving entities draw their authority from separate sovereigns but also whether the two law-enforcing entities do so.

The government disagrees. It says that the separateness of the offense-defining entities is all that matters. But that position would invite the precise abuses that the Double Jeopardy Clause was intended to prevent, and the CFR courts themselves provide the evidence. In arguing otherwise, the government focuses on a single word, "offense," which it takes entirely in isolation and to which it applies rigid dictionary definitions. But the Bill of Rights prevents not only transgressions of the amendment's literal terms but also governmental efforts to circumvent their protections.

Indeed, I suspect that when one civilization displaces or conquers another, the side that had more technology gets to write the prevailing historical narrative of self-glorification. A shame really, seeing as western civilization still venerates the ancient Greek philosophers, despite their relative technological inferiority to modern society.

As i said I have only recently become aware of some of these ideas. I personally wonder whether I would have been much more fulfilled in life living as some of the Native Americans were in the 1600-1700's (I realize there is wide variation among cultural practices here). A community working together to provide the basic needs of food and shelter for all while ensuring personal liberty and autonomy is something we can't even manage with all of our 'scientific progress'.

Depends on what felony. My brother is in prison and is trying to get out early on some woke bullshit. I think he should stay, but I also am worried about who he’s with in there because there’s not a lot of natives. People in prison know we get money so I worry about him becoming gang affiliated and not knowing what the fuck that means. Kinda makes me wish we did keep them in our own prison on the reservation.

Usually they issue notice that the person is barred in the newspaper AFTER they’ve already been removed from the reservation. And yeah, if you commit a felony on reservation, you go to federal prison. Even if it’s a tribal member committing a felony, they might be held for a bit in tribal jail, but same.

Do you mean though, if an illegal immigrant is found on your reservation, the native american authroties, whomever they may be, I mean whomever is in charge, they will detain that person then drive and deliver them to some federal prison? As for "inalienable rights", I've always argued those don't exist - that it's simply a fantasy or wishful thinking. This is mainly because inalienable means "can't be taken away". So if they're taken away, it disproves inalienable.

Same applies if they're called human rights instead. If something can be taken away, it's not a right. Anyway, that's how my logic works.

My post was on the case because of Indian giving. Yeah, it’s a racist practice, but the case is about accountability. For someone who has a post up on race versus class, you’re not seeing how in this case, the school tried to exclude themselves from honoring a verbal contract with the people.
