This Court has consistently assumed the importance to the dual-sovereignty doctrine of both expressions of sovereign power. The analysis thus asks not only whether the two law-giving entities draw their authority from separate sovereigns but also whether the two law-enforcing entities do so.

The government disagrees. It says that the separateness of the offense-defining entities is all that matters. That is not an outcome that the framers of the Double Jeopardy Clause would have thought tolerable.

In arguing otherwise, the government focuses on a single word, "offense," which it takes entirely in isolation and to which it applies rigid dictionary definitions. But the Bill of Rights prevents not only transgressions of the amendment's literal terms but also governmental efforts to circumvent their protections.

Indeed, I suspect that when one civilization displaces or conquers another, the side that had more technology gets to write the prevailing historical narrative of self-glorification. A shame really, seeing as western civilization still venerates the ancient Greek philosophers, despite their relative technological inferiority to modern society.

As i said I have only recently become aware of some of these ideas. I personally wonder whether I would have been much more fulfilled in life living as some of the Native Americans were in the 1600-1700's (I realize there is wide variation among cultural practices here). A community working together to provide the basic needs of food and shelter for all while ensuring personal liberty and autonomy is something we can't even manage with all of our 'scientific progress'.

I recently read about the contributions of the Iroquois speaking philosopher Kandiaronk to the French Enlightenment in David Graeber's new book 'The Dawn of Everything'. It's a fascinating read for anyone interested in this topic, and certainly think there were Native American groups that western civilization could continue to learn from.

yeah him being in prison can for sure be a problem for him, but of course if he is guilty he deserves to be there. Yeah in a perfect world you'd have your own prisons, and your own everything that a sovereign country has, but that is difficult logistically. Natives sometimes make good money on things like pipelines or casinos, many other things, maybe they could afford to build their own prisons someday. Woke people would shreak but who cares. It's not a fun topic but prisons are important.

Depends on what felony. My brother is in prison and is trying to get out early on some woke bullshit. I think he should stay, but I also am worried about who he’s with in there because there’s not a lot of natives. People in prison know we get money so I worry about him becoming gang affiliated and not knowing what the fuck that means. Kinda makes me wish we did keep them in our own prison on the reservation.

I guess that's fine as long as they go to a prison, would you want to create and maintain your own huge prisons, probably not. Would you be angry at all if say a tribal member did commit a felony, it's proven guilty and all, but the fed govt decided to let them out of prison? Sometimes they do that, shortening sentences for woke reasons or because of the pandemic.

Usually they issue notice that the person is barred in the newspaper AFTER they’ve already been removed from the reservation. And yeah, if you commit a felony on reservation, you go to federal prison. Even if it’s a tribal member committing a felony, they might be held for a bit in tribal jail, but same.

Do you mean though, if an illegal immigrant is found on your reservation, the native american authroties, whomever they may be, I mean whomever is in charge, they will detain that person then drive and deliver them to some federal prison? That would make sense, it would be a longer drive and unnecessary to drive them all the way to mexico or whatever country. It's your soverign land though so the main thing you would care about is getting them out of it.

Original goal of Landback movement, to expand land and hold stewardship over greater areas. Some tribes just wanted land acknowledgment.

It's not a states issue it's a fed govt issue to enforce the borders.

And they only do when it comes to regular citizens, while people working in government offices donate and receive donations from orgs to further illegal immigration.

And like you said, it’s up to the fed gov whether or not to deport someone. I believe if found on tribal property, the person will be taken to a federal prison facility, but I’m not 100%

Academia has been diverted by authoritarian nerds who just want to replicate themselves to serve those in power.

So no one has human rights, so why have any laws at all? It doesn’t matter how wishful the thinking behind it is, we’ve created the system that hinges on rights of individuals. Even those who violate laws have rights as citizens, except in very specific cases, historically. Or recently in broad general cases, for example the NDAA, which should be nullified or amended at the very least.

There’s already been illegal immigrants barred from my reservation for crimes against tribal people, so trust me, I’m aware.

In AZ, it’s their land to decide if they want a wall or not, regardless of what you and I think, regardless of the greater impact for immigration UNLESS the gov admits they’re aiding a rebellion or insurrection, in which case they are guilty AND SO IS EVERY ORG HELPING IMMIGRANTS. Some believe the raison d'etre for college students these days is to learn new ways to be offended.

As for "inalienable rights", I've always argued those don't exist - that it's simply a fantasy or wishful thinking. This is mainly because inalienable means "can't be taken away". So if they're taken away, it disproves inalienable.

Same applies if they're called human rights instead. If something can be taken away, it's not a right. Anyway, that's how my logic works.

Racial humor can be pretty funny. What the leftist-scolds are missing is what's left when you force the humor out of it.

I have never found an explanation from both sides that agrees on who started it. I know some college natives who say it’s offensive, maybe they’re right?

There’s a famous artist Cheyenne Randall who uses it as his instagram @, I know there was a band Indian Giver, I know other artists who use it, who use wagon burner, the list goes on. I’ve found it’s used in jest more often than not. That’s why I used it here, to make fun of the situation, but the humor doesn’t always translate in text.

There is no doubt a ton of misunderstandings took place, but here we are, regular citizens getting fucked over by the tyrannical practice of “Indian giving” us our “certain unalienable rights” whenever they want.

I believe it was a difference of opinion. The perception was that Indians would 'give gifts', then later want them back. It's been a long time, so I don't remember the specifics. Could have been land, hunting rights, or anything really. Two completely different cultures are likely to misunderstand the others intentions and practices.

Because this nation was founded on Law, if we’re going to continue as a nation of law then that shit needs to be applied equally. The laws written for us are the only thing stopping them from completely stripping rights from all citizens. Our lands were granted to us as sovereign nations, if they can seize those lands for corporate interests, there is nothing stopping them from doing that to all citizens. This is why LANDBACK has been hijacked. This is why they have people like you arguing about a wall instead of who has the real power to dictate what happens on their PRIVATE PROPERTY, their SOVEREIGN LANDS. Are they going to strip the rights of CITIZENS in Arizona for occupying their own lands? If they do, then the charge would have to be REBELLION OR INSURRECTION. Technically, an Indian giver is an Indian, because of the first word in the term. Indians and the receivers apparently had differences of opinions over gifts vs loans. Indians wanted the presumed "gifts" back, so the term Indian giver was born.

My post was on the case because of Indian giving. Yeah, it’s a racist practice, but the case is about accountability. For someone who has a post up on race versus class, you’re not seeing how in this case, the school tried to exclude themselves from honoring a verbal contract with the people.

I’m not talking about now, I’m talking about the case and the time period. The town told the tribe their children could go to the new school, they were denied entry, so they sued. The end. We wouldn’t even have known that it was possible to hold Indian givers to their word if it wasn’t for education received from the whites on how “their” system works. We were forced to assimilate, so it’s our system too now, much to your chagrin.

You seem to know who created the school system, maybe this is the first time you’ve heard this, but the whites haven’t always been as receptive to hearing a brown person say bad things about a fellow white. Sometimes, it’s crazy I know, they would actually punish the browns for even suggesting a white did something wrong! So maybe, a brown committing a crime to punish a very bad white would bring trouble to the brown community.

The point is, don’t force us into sub-par educational facilities to denounce our culture and assimilate to be real Americans if you don’t want us to use your real American system to elevate ourselves and hold you to your word.

Yeah it’s fucked up. Current generations are barely learning about inter-generational trauma. It’s getting better, but it’s going to take time.

I am more concerned about academia hijacking movements for sovereignty to tie them into global authoritarianism. I’m pretty sure the tribe was under the impression they’d be able to attend the new school since that was the agreement for the votes. Typical Indian giver shit. Maybe there was help with the case, but I believe it was the tribe’s idea to seek help.
