If the guy's an active marine going to war in the Ukraine makes him AWOL. If he isn't AWOL and an active Marine then his activities were covert and sanctioned by the US Federal government.

Officially he is a “veteran” Marine.

The US government made an exchange for him and he’s barely back on US soil and he goes off to fight Russians in Ukraine and is again requesting US government assistance to get out of Ukraine and to be treated at a US military hospital in Germany. Does the US do this for all mercenaries?? Doubtful. Which leaves us to assume he was in Russia before and now in Ukraine as a covert operative.
