On the one hand, yeah, straight up poison is an escalation that really doesn't fit the crime.

On the other hand, doesn't matter if the thief gives the sandwich to someone else or keeps it themselves, they're still a thief.

I think the point about giving it to someone else is in reference to part of the reason that it's illegal to "Booby Trap" something or somewhere and claim: "If you're not a thief, you won't die, so just don't be a thief".

If I steal your sandwich, but then decide I want Chinese and give it to a homeless beggar, then he dies, an innocent third party has now been killed, not the thief. Same as putting a tripwire shotgun at your door. If a home invader gets their leg blown off? Fantastic, I sleep. If a cop who got called out because the neighbours think you've died in the bathtub or the EMT who can't get a response from you after you call saying you've had a heart attack gets their leg blown off?... Well, that's not nearly as funny.

That being said, I know, if someone was stealing my lunch, the urge to have a nice Ratsack and whatever-that-thing-is-under-the-fridge sandwich tomorrow would be powerful.

Yeah, I didn't mean to suggest that someone other than the thief getting hurt by a laced sandwich is fine and dandy. More that the responsibility lies on the thief, and they don't suddenly get absolved for being such just because the bullet (so to speak) missed them and got a bystander instead.

Yeah, agreed... Though, I think there are cases of the thieves basically getting off scot free due to booby traps. I seem to remember a dude setting up a shotgun in a house he wasn't staying at and blowing off some bloke's leg?

I wish we were more harsh on thieves as a society. Deciding to just take shit that isn't yours because you feel like it displays a lack of basic humanity. Thieves should be punished heavily and made an example of
