Nope. Should be manslaughter, probably didn’t intend to kill the man but he did. The judge can take the racial abuse into consideration when he is considering mitigating circumstances for sentencing purposes.

However, if the guy has made statements about how he would kill anyone who calls him that word, then that’s probably good enough to prove intent and that’s murder, baby.

Don’t say shit about what you plan to do, if there’s any chance you could be in court for doing that shit in future.

Just this month I was on my very first jury duty and the judge told us no less than 4 times to not be racist, but in legal-speak.
