Hmm, kind of a tough one. He signed a settlement agreement that stipulated that he couldn't talk about Tesla without pre-approval. Now he's saying that agreement was unconstitutional.
But he signed it. On purpose. That does really seem to weaken his case here.

If he was forced to sign something it means nothing. And contracts are always subject to change if a clause in the contract violates the law.
If the same rules do not apply to everyone who owns stock, or at least every CEO who owns stock, then it is clearly a violation of his constitutionally protected rights.
