If the warden is made aware of crimes via reports and doing nothing about it then he is culpable under the law. Also, prisons are not designed to protect criminals and their criminal organizations but the opposite, to protect the civilians from criminals. So, the Silk Road would be an equivalent of a gang farmers market with Ross renting out the stalls, tables and land , inviting civilians to come and shop for what ever they want.
