Yeah if it's true it's simply false advertising.

If you sell a 24 oz cup and there's less than 24 oz in it that's no different than telling someone the price is five dollars and charging their card six.

It's basically fraud. Should be punished severely.

    Mcdonald's sells you a $2.40USD 32 oz cup of soda that is 75% ice so it is less than 32 oz soda.

    Totally unrelated, but there used to be a restaurant down at the end of Fremont Street in Vegas that had a neon sign out front that said they had the world's largest pint of beer.
