Hate speech can be made by minorities, and does not say that everyone is equal.

Doesn't matter who says it. Certainly doesn't claim that everyone is equal, because it targets an identifiable group.

But it does matter who prosecutes "hate". Selective punishment cuts all ways always.

Being treated unfairly by the court is less subjective.

You can compare the outcomes for similar situations for people of dissimilar backgrounds or demographics.
