I don’t believe the Supreme Court addressed Meese’s argument. The court just refused to address Smith’s request without issuing a reason.The court did not state that it refused the request due to Smith’s legitimacy.

It’s an interesting arguement considering the typical Biden administration funny business that went into appointing Smith as special persecutor.
