The government is choosing to censor and working with private companies to enact this censorship. That makes this an explicit and flagrant violation of the First Amendment. They've come out in the open now. This is an explicit challenge to the entire concept of freedom of speech. They're asking the public, "Are you willing to challenge us on this?"
