The fact that the dad was an ex officer makes his decision to play vigilante with his son all the harder to forgive. Note in the video an real cop drives by within 90 seconds. The suspect would have been caught anyway, by a real LEO, had they done the proper thing, observe and report.

Suspect was NOT OUT FOR A JOG, suspect was twelve miles away from his own neighborhood, caught on video more than once breaking into houses in their neighborhood, shooters had seen him and called it in to police previously, they have him on video entering the construction site in shoes and leaving in stolen work boots, they called police and were performing a citizens arrest of a fleeing criminal. That criminal then attacked a man who was carrying a shotgun, and signed his own death warrant by fighting to take the shotgun, turning what would have been a CONVERSATION into a life or death struggle.

Open carry is legal in Georgia. Pursuit a fleeing criminal suspect is legal in Georgia. Making a citizens arrest is legal in Georgia. Shooting someone who tries to rip a gun out of your hands is legal in Georgia.

When people who are not trained police officers pretend to be, accidents happen. Cops are required to take all sorts of training courses, the vigilante son, did none of that. His only qualification was owning a shot gun. But who cares, the latest white on black murder has made people forget all about this one. Now there are riots.

Aggravated Assault is one of the most serious crimes in GA up there with murder, Rape, Armed Robbery.

To commit Assault in Ga you need not actually phisically hurt someone

O.C.G.A. 16-5-20 (2010) 16-5-20. Simple assault

(a) A person commits the offense of simple assault when he or she either:

(1) Attempts to commit a violent injury to the person of another; or

(2) Commits an act which places another in reasonable apprehension of immediately receiving a violent injury.

Simple Assault is just a misdemeanor. What makes it aggravated Assault is that they were armed with a deadly weopon.

6-5-21. Aggravated assault

(a) A person commits the offense of aggravated assault when he or she assaults:

(1) With intent to murder, to rape, or to rob;

(2) With a deadly weapon or with any object, device, or instrument which, when used offensively against a person, is likely to or actually does result in serious bodily injury; or

Then the fact that they killed a guy during the commision of a felony makes it Felony Murder. Its literally the same thing as murder except the prosecution doesnt have to prove they meant to kill him. The punishment is Life or Death.

16-5-1. Murder; felony murder

(a) A person commits the offense of murder when he unlawfully and with malice aforethought, either express or implied, causes the death of another human being.

(b) Express malice is that deliberate intention unlawfully to take the life of another human being which is manifested by external circumstances capable of proof. Malice shall be implied where no considerable provocation appears and where all the circumstances of the killing show an abandoned and malignant heart.

(c) A person also commits the offense of murder when, in the commission of a felony, he causes the death of another human being irrespective of malice.

(d) A person convicted of the offense of murder shall be punished by death, by imprisonment for life without parole, or by imprisonment for life.

They werent allowed to citizen arrest him because they didn't see him commit a felony. Tresspassing isnt a felony and they didnt even see him do that.

17-4-60. Grounds for arrest

A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.

Amazing how you took the time to compile all that and you still don't know wtf you're talking about.

  1. Intent to rob is the felony that "Armed Robbery" committed, not trespassing.
  2. A citizen arrest was never committed nor attempted according to the video. Armed Robbery was neither confronted nor attempted to detain when he attacked a good Samaritan unprovoked. The only thing they did before that was yell "Stop"
  3. They don't need to see him commit a felony. They can arrest him on reasonable suspicion. Pretty damn reasonable to assume the only guy sprinting away from the burglarized home with a hammer.

I admittedly did not compile it myself, but it was a copy & paste from a Reddit thread about it. All of the bolding and strikeout was done by them as well. But they directly cited the Georgia law statutes.

Though I would think that a citizen does not have the right to arrest on reasonable suspicion like a LEO does, but this is irrelevant if you admit that they did not even try to do it anyway.

Lmao, did you really just say that if I kill someone committing a felony, then I get charged with a felony murder? You clearly don't even understand what you are talking about. Dude, it is felony murder if the person committing the felony causes a murder.... not the people that killed a person committing a felony.

My guy, LEO don't have special or extra rights than, what you would call, 'normal' citizens. The police only make it seem like they do, through use of force. But armed citizens could arrest an officer, or anyone else, for that matter. That would actually hold them accountable, if militias kept police in check. Police are also useless, never showing up to actually help, but only show up late and also shoot your dog.

Firefighters don't go around fishing for fires.... and cops shouldn't go fishing for crimes. They should stay put until called, just like firefighters.
