This is a strange story. The video shows the man running towards the people who shoot him, and being followed by a seemingly uninvolved bystander. There must have been more that occurred before this video starts that would give the proper context.

They were blocking his path, because they wanted to accuse him on the spot of committing a burglary in the neighborhood, and it's pretty obvious their only cause to suspect him in the first place was that he was black. So the black guy tries to go around their blockade, and then it looks like the black guy snaps and goes for the sons gun, and I think he snapped because in the short period of time before the black guy is shot, it looks like he's trying to assault him rather than simply run away. The victim was a high school "football star", so he might have thought he had the skills to take the son down.

Even if they could convince a jury that the black guy attacked first, I'd still think this would constitute manslaughter for having played vigilante in the first place.

That's one thing I have about encouraging kids to play football, I think it can condition some people to turn to sudden violent solutions rather than slow down and think things through. Not 100% sure that happened here, but still.

The fact that the dad was an ex officer makes his decision to play vigilante with his son all the harder to forgive. Note in the video an real cop drives by within 90 seconds. The suspect would have been caught anyway, by a real LEO, had they done the proper thing, observe and report.

Suspect was NOT OUT FOR A JOG, suspect was twelve miles away from his own neighborhood, caught on video more than once breaking into houses in their neighborhood, shooters had seen him and called it in to police previously, they have him on video entering the construction site in shoes and leaving in stolen work boots, they called police and were performing a citizens arrest of a fleeing criminal. That criminal then attacked a man who was carrying a shotgun, and signed his own death warrant by fighting to take the shotgun, turning what would have been a CONVERSATION into a life or death struggle.

Open carry is legal in Georgia. Pursuit a fleeing criminal suspect is legal in Georgia. Making a citizens arrest is legal in Georgia. Shooting someone who tries to rip a gun out of your hands is legal in Georgia.

Aggravated Assault is one of the most serious crimes in GA up there with murder, Rape, Armed Robbery.

To commit Assault in Ga you need not actually phisically hurt someone

O.C.G.A. 16-5-20 (2010) 16-5-20. Simple assault

(a) A person commits the offense of simple assault when he or she either:

(1) Attempts to commit a violent injury to the person of another; or

(2) Commits an act which places another in reasonable apprehension of immediately receiving a violent injury.

Simple Assault is just a misdemeanor. What makes it aggravated Assault is that they were armed with a deadly weopon.

6-5-21. Aggravated assault

(a) A person commits the offense of aggravated assault when he or she assaults:

(1) With intent to murder, to rape, or to rob;

(2) With a deadly weapon or with any object, device, or instrument which, when used offensively against a person, is likely to or actually does result in serious bodily injury; or

Then the fact that they killed a guy during the commision of a felony makes it Felony Murder. Its literally the same thing as murder except the prosecution doesnt have to prove they meant to kill him. The punishment is Life or Death.

16-5-1. Murder; felony murder

(a) A person commits the offense of murder when he unlawfully and with malice aforethought, either express or implied, causes the death of another human being.

(b) Express malice is that deliberate intention unlawfully to take the life of another human being which is manifested by external circumstances capable of proof. Malice shall be implied where no considerable provocation appears and where all the circumstances of the killing show an abandoned and malignant heart.

(c) A person also commits the offense of murder when, in the commission of a felony, he causes the death of another human being irrespective of malice.

(d) A person convicted of the offense of murder shall be punished by death, by imprisonment for life without parole, or by imprisonment for life.

They werent allowed to citizen arrest him because they didn't see him commit a felony. Tresspassing isnt a felony and they didnt even see him do that.

17-4-60. Grounds for arrest

A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.

Had they called the police and didn't play vigilante, nobody would have been killed. Even if you're 100% right, they white antagonists are still guilty of manslaughter.
