The European Court of Human Rights has ruled that Bulgaria has violated the right to privacy of a woman who considers herself a man because a Bulgarian court has rejected her request to change her officially registered name and gender. The ECHR obliges Bulgaria to pay the person moral damages amounting to 7,500 euros ($ 8,500), according to dpa and Agerpres.
The ECHR noted that other Bulgarian courts have approved changes to civil status registers in similar cases and the matter is currently before the country's Supreme Court of Cassation.
The applicant complained to the Strasbourg court that, after removing her breasts, she also wanted to have the final sex change operation, but the doctors refused this procedure until a court decision was issued confirming the sex change in the documents.
A Bulgarian court rejected the woman's claim as legally inadmissible, even though she accepted that she considered herself male, lived as a man and had breast surgery.
