That's what this is all about, sending a message.
The process is the punishment. They'll drag you through the system even though they know they'll lose ultimately. The message is "You can to the line or we'll make your life miserable even if we can't get rid of you."
That's messed up, but he didn't get fired. He just has to work two unpaid weeks.
