That depends on the person determining their sex. If one starts making concrete rules such as "penis = male" or "XX = female". Then you end up with contradictions.

you realise that in the cases it might be confusing we are talking about 0.00265% of cases right?

What you call "intersex" is actually people with DSD (Disorder of Sexual Development). The overwhelming majority of them only have some fertility issues which only are discovered when they try to have children but are otherwise just men and women like everyone else.

The overwhelming majority of people with DSD are clearly men and women. penis = male and vagina = female is 99,9% of the case absolutely correct.

The fact that they are "othered" like some fucking freakshow just so the gender cult can use them as some sort of weird argument that transwomen , who 99% of them do not have DSD, is a real thing is just looney tunes.

Male = small gametes, female = big gametes. That's how biology differentiates sexes. And that ability does not appear out of nowhere, so disorder in its development do exist, but this does not negate the fact that there are only two sexes. Just like people born without legs do not negate the fact that humans are bipedal.

Well, that particular person is not bipedal. And if you breed enough of them then those humans are not bipedal.

That's how biology differentiates sexes.

There's no law that states a species is limited to two sexes, male and female. There may be organisms with three sexes. Or even more.

Also, if you breed humans that are born without legs long enough, then humans will indeed have a species that is not bipedal.

Intersex people have nothing to do with gender identity and are all either male or female with developmental disorders.

So why bring them up?

That's not right. Intersex is an umbrella term. However, if a human is born with a vagina and a scrotum, there is no concrete way to define if the person is a male or a female. Thus, the individual is "intersex."
