This whole situation pisses me off.

What were the alternate scenarios if this thing escalated? They either let the protesters hurl rocks through their window while the couple sit inside shouting "We're on your side!".... OR they wait until protesters hurl rocks through the window and shoot them dead.

To me, it makes more sense for them to outside saying "We're armed, so lets not escalate this."

And to say that people are not allowed to defend their property during riots is just plain bullshit. Is it because they were the homeowners? If they would have been hired security guards would it have been ok then?

This whole thing just feels like an intimidation practice by the City of St Louis to tell people they are helpless during the riots.

Peaceful protests my fucking aunt fanny.

The alternate scenario is that they sit there with their guns instead of pointing them at people with their finger on the trigger while yelling back. How the fuck is she completely unaware of the rules of gun safety in this day and age?

the guy had his gun down but drawn, the woman did have it pointed at people. Foolish but I think the case could be made they were in clear and present danger, despite media saying they were peaceful protests at the same time there were plenty of reports of the looters around the country killing people so it was a valid fear.

I've read her gun wasn't even real. He said she doesn't know shit about guns.

Watkins told reporters the pistol Patricia McCloskey used was only a prop from a federal trial that the couple used in a case. Both of them are attorneys.

that by itself I wouldn't use as a defense because it's like the teen black kid that had a bb gun and cops killed him but they couldn't know it was a fake gun and in a situation like that you don't have time to go up to a criminal with a gun and check to see if it is real or not.

Unfortunately, just because the police killed him, doesn't mean he was committing a crime.

I quoted the statute for you below... but is a BB gun considered lethal? I don't even know.

We're going to dismiss the charges that have no legal standing. Don't worry people already got the picture, if you fight the mob the state will go after you and remove your rights to protect yourself. Fucking disgusting and those people should have stood up for themselves legally instead of defending the police.

Why the actual fuck would you feel bad for the people who are trampling over your rights. Oh they didn't want to, I'm sure some of the people enforcing soviet law didn't want to execute people or send them to the gulags but they fucking did feeling bad doesn't justify doing it.

Yeah the "protesters" broke down the iron gate to their neighborhood which also had "No trespassing" and "private property" signs on the entrance and proceeded to March to the mayor's house. So at that point the protesters were on private property and I dont see how they weren't within their rights to defend their property. They are being charged with a felony count of unlawful use of a weapon.

The St.Louis Circuit Attorney Kim Gardner who charged the couple said "it is illegal to wave weapons in a threatening manner at those participating in nonviolent protest" But they destroyed property so I think most people have a different definition of "nonviolent protest" than Kim Gardner has.

wasn't Kim in on the Jussie hoax?

I'm not sure. That was in Chicago I believe.

    Yes my mistake

    [–]TruthTeller 8 insightful - 2 fun8 insightful - 1 fun9 insightful - 2 fun -  (22 children)

If anything they should be charged with gross incompetence for the way they were handling their weapons.

The way the wife was limp-wrist waving around that gun with her finger on the trigger was one of the cringiest and stupidest things I've ever seen.

    [–]Yayme 3 insightful - 1 fun3 insightful - 0 fun4 insightful - 1 fun -  (17 children)

It wasn't a real gun. And she doesn't know shit about guns, they already said that.

The inoperable pistol was taken by police while the AR-15 rifle that Mark McCloskey was holding, was reportedly seized by police on July 10, 2020 at the home

I see, how was anyone else supposed to know this?

    [–]Yayme 2 insightful - 1 fun2 insightful - 0 fun3 insightful - 1 fun -  (15 children)

Um, read it? Just like I did?

Or do you mean the people rioting? They weren't supposed to know. That was the whole point. It's called a bluff.

    [–][deleted] 1 insightful - 1 fun1 insightful - 0 fun2 insightful - 1 fun -  (14 children)

Sorry yeah the protestors and the police. It only makes sense that they were arrested for "flourishing a gun" if by all looks and appearances you have someone with a loaded gun and no gun training pointing it at people.

    [–]Yayme 3 insightful - 1 fun3 insightful - 0 fun4 insightful - 1 fun -  (13 children)

They've told the police. That's why the whole felony weapons charge probably won't stick either, and it's probably a bluff too. The weapon has to be lethal for it to be a felony charge, I believe.

Which is why the keep reporting that his was unloaded and there was no ammo in the house.

    [–][deleted] 1 insightful - 1 fun1 insightful - 0 fun2 insightful - 1 fun -  (12 children)

is it a felony to point a fake gun at people tho.

    [–]Yayme 2 insightful - 1 fun2 insightful - 0 fun3 insightful - 1 fun -  (11 children)

2005 Missouri Revised Statutes - § 571.030. — Unlawful use of weapons--exceptions--penalties. 571.030. 1. A person commits the crime of unlawful use of weapons if he or she knowingly:

    (3) Discharges or shoots a firearm into a dwelling house, a railroad train, boat, aircraft, or motor vehicle as defined in section 302.010, RSMo, or any building or structure used for the assembling of people; or

But you didn't answer the question. All you did was copy and paste one statute that is irrelevant to whether or not threatening someone with a fake gun is a felony. Try again:

is it a felony to point a fake gun at people tho.

    [–]TruthTeller 2 insightful - 2 fun2 insightful - 1 fun3 insightful - 2 fun -  (0 children)

Ahhahah! HAhah! I died when I saw that. That's what you get in an insane gun culture where anyone can buy any amounts of guns and ammo. You get every asshole in the book walking around ready to shoot themselves. When I saw her with that gun I became certain that is not what the Founding Fathers had in mind.

    [–][deleted] 2 insightful - 1 fun2 insightful - 0 fun3 insightful - 1 fun -  (0 children)

I suppose it was technically illegal, now was it a felony. And it's not fair since none of those looters were arrested for breaking into that comunity. Those people specifically moved to a gated community because they knew a ghetto is really not that far in St Louis. It is white flight yes but they wanted to stay away from the criminals not kill them.

    [–]horatioherbert 7 insightful - 1 fun7 insightful - 0 fun8 insightful - 1 fun -  (0 children)

You should be free to point your weapon at someone(s) threatening your life and property

    [–][deleted] 5 insightful - 2 fun5 insightful - 1 fun6 insightful - 2 fun -  (0 children)

give them back the gun too
