To me it looks like the cop wanted him dead rather than escaped with a taser on foot while drunk.
The cop got tired of the struggle and ended it - though they could have traced him later from documents.
It's a pretty dumb move to tase a cop. But the punishment should fit the crime, and cops should not do the punishing.

My personal view: What if runs again? They can just catch him later? Will he keep drinking and driving until he kills himself and someone else?
I'm really not a let them run kinda guy. Just letting them run means the law is meaningless.

He can't run forever. The police outnumbers and outspends him, and documents are shared across the police force. Also, he'd be missing a car now.
DUI has lawful punishments, and being shot dead is not one of them.

He just needs to run whenever the police try to apprehend him, or until he has a fatal accident in a DUI.

The police, now knowing that the guy can evade 2 cops, could organize a stakeout at, say, his home, with more than 2 cops.
Also, perhaps the guy would not be so eager to drink and drive again, having had an encounter with the police.

Watch the surveillance footage. Brooks resisted arrest. Physically fought two police officers. You can see Brooks on top of the officers SWINGING. He then takes an officers taser. While running he fires the taser at the cop who holds a firearm (cop could easily end up dead in such a situation). The officers life was threatened and he acted within his rights.

The officer could have dropped his gun while tased. Brooks could have ran back and stolen the gun. Why would the cop assume different?
Because Brooks was running away and was quite far when the cop shot him.
