    We are a limited republic. On some matters democratic opinion is supposed to be irrelevant.

    By design. But the issue is that the public isn't dumb, while some of the public is very dumb. So ignoring intelligent opinion is a liability as oppose to a necessary evil.

    Should we have a vote on whether or not you get due process or if we can violate the 8th amendment in your case?

    Believe it or not, you could divide up the public in question and have a rogue agent as part of a cult, get elected; subvert all processes to un-do the 8th amendment, due process etc. Parts of the population would actually clamor for these ideas! Highlighting that minority could push it through by subversion...

    It seems that we are in an interesting storm, of the ignorant elites vs. a populace in recognizance.

    Edit: Maybe the only thing that could solve this storm is Artificial Intelligence, but that is not certain due to the fact that it is black-box and maybe even controlled by the elites.
