Because sameness is not justice! That is not equality, neither with trans-people nor with men vs. women. Not all disparity of outcome is discrimination. Not all discrimination is unfair. We discriminate all the time between men and women.

Remember the frustrations countless people have had when pointing out the hipocrisy of feminism when it came to the selective editing of gender disparity in legislation, such as the rate at which women get custody or the Selective Service Act, or the differences in suicide.

"Oh, we'll get to that!", "Well, men are doing this to themselves. That's just their toxic masculinity."
