He said he couldn't breathe multiple times way before hitting the ground, because he was scared, because he was claustrophobic, etc. I think this guy just had a problem with breathing in general.

the defense attorneys are smart to request this. no way this is murder or even manslaughter. the prosecution is going for gold and that can be a huge mistake. a jury should not convict unless ojs jury is back

Prosecutors want a win and by necessity pick the charges based on what they believe can get a conviction. Because once they get a not guilty, its game over. Being over the top and going for murder will not work. Unless the jury is corrupt.
