Nope. Should be manslaughter, probably didn’t intend to kill the man but he did. The judge can take the racial abuse into consideration when he is considering mitigating circumstances for sentencing purposes.

However, if the guy has made statements about how he would kill anyone who calls him that word, then that’s probably good enough to prove intent and that’s murder, baby.

Don’t say shit about what you plan to do, if there’s any chance you could be in court for doing that shit in future.

Just this month I was on my very first jury duty and the judge told us no less than 4 times to not be racist, but in legal-speak.

Yeah the poll is poorly worded. There's some number of people who probably answered not guilty with this in mind.

But there's likely some number of people who would have said not guilty even if the worker intended for the punch to kill the customer and punched the guy out for no reason, solely because he wanted to punch out and delete a white person.
