You have judges, they’re supposed to weigh mitigating and aggravating factors when sentencing, not to mention, prosecutorial discretion too.

The fact is the Common Law court system has a fairly decent set of tools available for sorting through all the factors of an offender’s offending and as long as they are used there’s not much to say about any of your examples, a judge would be able to decide upon receipt of a guilty verdict from a jury. A sensible prosecutor might opt for not trying certain cases, based on the facts available.
