What do you do with an adult fucking a 17 year old. Let’s say a 35 year old. Then a 28 year old. Then a 24 year old.

Now let me add in that the 35 year old and 28 year old met the girl through normal means, like worked together. Both live and cherish the younger girl and would like to marry and support her for the rest of their life.

The 24 year old and 17 year old are equally in love. 24 is not quit established yet.

Now switch the sex’s. What about if it’s the same scanario but the older one is a women. But she just wants to fuck him and move on.

Next scenario.

What if it’s like a rapper, and a 15 year old that was in a 21 year and older club?

What if it’s not a pedofile, like, for whatever reason, there’s a sleep over, and it’s like a 9 year old girl who gets assaulted, but the guy was on that crazy night time sleeping drug, that shit rosanne was on when she said that racist shit.

Or even drinking was involved, and the person is normally a good person, but was not, one time.

I’m not giving these scenarios my blessing, like it’s okay. But could you share your opinion on these hypotheticals.

Like what is your rule for these things. When it’s not just clean cut, old man forcefully taking advantage of a little girl or boy.

Do you think these people deserve to be raped in jail.

You have judges, they’re supposed to weigh mitigating and aggravating factors when sentencing, not to mention, prosecutorial discretion too.

The fact is the Common Law court system has a fairly decent set of tools available for sorting through all the factors of an offender’s offending and as long as they are used there’s not much to say about any of your examples, a judge would be able to decide upon receipt of a guilty verdict from a jury. A sensible prosecutor might opt for not trying certain cases, based on the facts available.

Well, on the plus side, u/RedEyedWarrior saying "Child molesters should be given the death penalty" kind of makes it clear that he's not exactly talking about the 15 year old who took a nude selfie of herself and sent it to her boyfriend or the boy a couple days older than his high school sweetheart who's parents hated him and waited until the second he turned 18 to get him arrested.

Lots of places have statutory rape as a strict liability offence, which means “I didn’t know he/she was under-age” is not a valid defence, you’re just straight out of luck, better hope that mitigation goes in your favour come sentencing. The solution to that problem, by the way, is to not fuck random strangers in toilets!

Of course, but that just explains how "woodchipper" is a good idea for the obvious child predators, but there's a lot of cases where it shouldn't be the only punishment forever.

No, I'm not talking about them. Teenagers having sex with each other is what teenagers do. Age of consent laws exist to protect teenagers from predatory adults. I believe the age of consent should be 17, but I also support a close age exemption if the older party is less than 3 years older than the younger party.

If someone over 18 has sex with a child under 10 or if someone over 21 has sex with a child under 13, then I back the death penalty for the molester.

Yeah, that's reasonable. (Personally, I'd go with the age of consent being 16, with the close age exemption going to a maximum of 14 [so it's "if they are old enough to go to the same high school as the older party, it is fair game." A little higher if, say, a senior dates a freshman, but also much lower if a sophomore dates a freshman.)

Good points. Ultimately, we both want to protect children- who cannot process sex - and teenagers- who are developing - from adults seeking to take advantage of their vulnerability.

I’m anti-death penalty, too many opportunities for innocent people to be executed, especially if it were opened up to sex offences. However, perpetual isolated incarceration, no visits, no contact with the outside world, they go into their cell, get fed through a hole in the door and have access to a digital library of books and videos, a treadmill, lavatory facilities and that’s it. For all intents and purposes they have been removed from the planet. I could live with that, because should a miscarriage of justice occur it can be rectified.

I’d call the facility housing the convicts “HMP Woodchipper”, and there’s a salt mine under the North Sea that would be perfect for the facility, only one way in or out and kilometres of winding tunnels miles below the surface. Station an armed guard at the entrance and no one is escaping or paying an unannounced visit.

I’d treat it similarly to the death penalty too, you’re held in a maximum security prison for one year post conviction, have full raft of appeals and legal pleadings, even a re-examination of the case and an independent panel of judges to confirm the verdict, and then on the set date, you get a final meal, visit with friends and family and then live on television for all to see, you are transported to your cell below the North Sea and locked in, never to be seen nor heard from again.

It’d be an available punishment for paedophiles, rapists/sex offenders and murderers but not mandatory.

I'm very pro death penalty but, only in cases of extreme offense and only when there are absolutely zero doubts that can be raised as to the person's innocence. If you're caught raping a baby on camera? Yeah I have no issue with the firing squad then.

He said she said type situations where the evidence is substantial but it's not 100% certain? Jail is sufficient. The main thing I think that needs to be said is that, the removal from society and potential to re offend is paramount, but I actually consider the death penalty to be a far more humane punishment than life in solitary, the issues is it's permanence in cases where there may have been a miscarriage of justice. Not the application of the punishment itself in legitimate cases.

I’m anti-death penalty, but not an absolutist about it. The reasons for my objection are:

Miscarriages of justice.
The state should not really be in the business of killing its citizens.
As practised in the US it is more expensive and ponderous than life without possibility of parole.
There is a reluctance amongst juries to convict if the death penalty is a possibility, for obvious reasons, but this can lead to it being imposed unevenly.

However, there are circumstances for which the death penalty is acceptable to me. One such circumstance is if a prisoner cannot be held safely, for example Evil Superman, the only solution for him is a kryptonite lethal injection as no prison could confine him reliably and the risk to the public from him escaping is far greater than any possible injustice. Sounds stupid, but people like Chapo and other Druglords are very similar, they have power and resources beyond some small countries and they are able to use them to escape confinement should be executed, for the protection of the public and as the only possible just penalty for the level of criminality and suffering they inflict.

Nah, they’re not there for rehabilitation, they’re there because they’ve proven themselves completely unable to exist in society and so we choose to remove them permanently from it. As we are not monsters, they would be provided with a modicum of comfort and entertainment but they will never breathe fresh air, see the sun nor speak to anyone else ever again (other than staff in the case of medical or mechanical need). This is punishment, but also protection - sometimes it seems that we have forgotten that the law-abiding citizens deserve to be protected from the monsters that do nothing but prey on them and seemingly care not whether they are caught and caged, prison for those individuals stopped being a concern a long time ago and simply became “the price of doing business”.
