Wouldn't it be pretty silly for the U.S. government to hold one of their own citizens - an innocent civilian - hostage?

Doesn't the US government frequently do so, and even legalised such under Obama in the Patriot Act which allows detainment of any citizen indefinitely without trial and confiscation of all assets without reason?
