I don't get it. We know cops are looking to "do their job" and I don't know if everyone got the memo but they say, if you disagree with the charges, go along with them and lawyer up at first opportunity.
It sucks to waste all that time, but should she not have hit the power button (which on most phones locks it by default) given up her phone and they have no imaginary charges to level. By the time they figure out how to hack it, maybe your motion to get it back will go through, or they smashed it (hopefully you backed up your stuff to the 'cloud') and you sue them for that in addition to your 'inalienable rights' being violated.
I think Chappelle, Rock or Tucker (Chris) did a few jokes on this. "Comply" then sue. Standing up for your rights at that point is, in their minds, just asking to be beaten. It's how they get the blue pfizer pills to work, the husband/wife beating.

Yep comply than sue. It's illegal for the cops to beat the shit out of you without proper cause, a comforting thought for you while bleeding out on the pavement.

You can of course question the cop if they've got the legal right to take it without a warrant. You can even ask if it's a "request" that you can turn down, or an order, which you can't. But if the cops say do it then you comply. Then sue. There's a time and a place to fight the cops, it's called a courtroom. It's not called a traffic stop, because you fight the cops there they actually have a legal cause to give you shit now. And you know, it's retarded to fight people who have guns.

If you are stupid enough to have drugs or contraband on your or whatever and they do an illegal search then any halfway decent lawyer can get the charges thrown out.

If you're actually innocent and they made up some bullshit charge to arrest you on all the more easy to get it thrown out. But don't fuck with the cops during the traffic stop.

Comply then complain.

As I am unsure how to read you here, because "the sarcasm is strong with this one" or seems to be... Did her crying in any way stop them from beating her? The answer does seem to be no.
People have said bullies like a challenge, so playing obedient possum might get you less of a beating, or you could use the punch a grizzly, crock, or shark in the nose method and see how that works for you. I'm betting the 20 - 40 other police that always have their back probably wouldn't take kindly to that, but you take your chances.
Now when you're lying there bleeding on the floor, if suing them for millions doesn't make Ben Crump dial your number, nothing will. And there's nothing more comforting than my uncle Ben helping me to get millions. If my family gets it after I'm gone? Well, YOLO right?

Hey you've gotta look out for yourself first.

I think she's well in the right here and the cops bungled it massively. But it's gonna be the taxpayers who foot the bill.

What I think she should of done is pretty simple. Say "you don't have a warrant you can't seize my phone" and when the cop tries to take it anyway, let them, don't physically fight the cops. At that point the retard cop has just bungled the whole investigation and anything they find on that phone is not admissible as evidence.

This cop was gambling that they had a dumbass who would cave when presented with evidence, they fucked up, there was no evidence, the dumbass stupid for fighting the cops but will soon be a rich dumbass, at your expense as the taxpayer mind you. And the cops involved will get "suspension" or "change of job" read "paid vacation".

I'm very pro cop so long as the cops are very pro law. This cop was not. Many cops are not. I'll jump to their defense when they actually stop someone dangerous. Like that dumbass kid walking around playing gangbanger with a toy gun he cut the orange tip off, got shot, died, stupid kid, cops in the right on that one.

This one beat up some girl and send her to jail over a fucking phone you don't have a warrant for? Just get the fucking warrant. Dumbass cop.

I read most of the article, so it seems like they were investigating a fire? Roomate called 911 or something. Her (the one with the phone) mom was a Chicago cop.
Thing is, arson is a crime, yes; If it was arson. However, just because there's smoke, does not mean there's a fire (deliberately set that is).
These cops, plain and simple, were on a "fishing expedition".
So there was no Breana Taylor type deal where there was a warrant for a crime (the selling of drugs) and then collateral damage. Rather, there was no crime, just finding out through the course of investigation what's what.
They thought they could intimidate her into, sure I'll give you my phone and you'll find out I or my roommates caused the fire cause we're cooking up the white man's drug, meth.
Her mom gave her some really dumb advice.. The cops just thought, like you said, she'd roll over.
A warrant was never in play here because it hadn't progressed to that level. A detective got all smart and thought she was going to make a statement, and when she didn't he got all pissy, take her away... charge her with whatever you're going to charge her with. That's some detective. He knew he had nothing, and then he invited them to throw a ham sandwich at her.
Sherlock Holmes aside, most crimes are solved by tips from citizens to a tipline or by stupid criminals making prosecution ridiculously easy. This, sadly, is real police work at its finest.

I mean he's trying to bully a confession and if it's before even the "we can get a warrant stage" of the process then it's way before bullying is an effective tactics.

The chick volunteered to go in to the office for a chat she's already making this detectives job easy. She could just have said, no. Which she will in the future.

Every time a cop pulls this dumbassery not only does it mean taxpayers fit the bill but it also means that it makes cops jobs much harder as people will (for good reason) refuse to talk with the cops.

What fucking college age girl is going to willingly surrender her phone? I mean please. If you've got a warrant take it, but they don't. She's already volunteering with the cops. You could probably just ask her for a transcript of the text messages and she'd give it.

If it's arson you'd think they'd find some evidence on site that would get them the warrant. I mean it's not like meth is that hard to hide eh?

The meth angle was just my speculation. But so much of what we hear about in the news is involved with drug sale/cooking/transport/rivalry I figure it factors into things in policing's mind often.
You're right on all those points. I think we agree.

Especially in the black community, cops just incentivized the "snitches get stitches" mentality that used to be the norm. And this is the daughter of a cop, so she's second generation trying to swim against the stream. That might have just ended.
