All he gets is charged with aggravated assault with a deadly weapon, if I did that I would be facing attempted murder.

It might have something to do with proving intent. Although it seems pretty bloody obvious that shooting somebody six times would reasonably be expected to lead to death, proving intent to kill might not be easy. Whatever their reasons for the charge, I hope it carries enough years to ensure this guy never sees daylight again.
